U.S. Department of Homeland Security Seeks Comment on Proposed Rule to Create Blanket Waiver of HIV Restriction on Non-Immigrant Visas

November 7, 2007 – The U.S. Department of Homeland Security (DHS) has published in the Federal Register a Notice of Proposed Rule-Making to create a blanket waiver of the statutory HIV restriction on non-immigrant visas.  There is a 30-day comment period.  The proposal is the result of President Bush's instruction to Secretary of State Condoleeza Rice and DHS Secretary Michael Chertoff to establish an across-the-board visa-waiver mechanism for prospective HIV-positive visitors to the United States on short-term business or tourism.
